Sorry, I’m a couple of days late providing a link to reporter Dan Eggen’s piece in Sunday’s Washington Post following up on the Office of Special Counsel investigation of Rachel Paulose’s management of the U.S. attorney’s office in Minnesota.

Eggen reviews l’affaire Paulose in general, confirms the ongoing special counsel investigation, and comes up with one more problem for Paulose that I didn’t have in last week’s modest scoop. The Office of Special Counsel is an independent agency within the executive branch, not part of the Justice Department. But according to Eggen’s sources, Paulose fared very poorly in an elaborate job review performed by her own department:

“In addition, an internal Justice Department audit completed last month said her employees gave her very low marks, alleging that she treats subordinates harshly and lacks the requisite experience for the job, said several sources familiar with the audit. Her performance review was so poor that Kenneth E. Melson, head of the department’s Executive Office for U.S. Attorneys, took the unusual step of meeting with her in Minnesota several weeks ago, two sources said.”

This surely represents another flare catching fire in the very small circle surrounding Paulose. It has the additional awkward potential to link back to the fact that most of the U.S. attorneys who were fired to make room for new, Bushier replacements, had received excellent job reviews.

All EARS on Paulose

The Justice Department employs an extensive process called EARS for evaluating the work of U.S. attorneys. Eggen is apparently referring to the recent EARS review of her office.

When an office comes up for review, a team of specialists called EARS (Evaluation And Review Staff) is assembled from U.S. attorneys offices around the country. They come to town and interview the U.S. attorney, the staff, and officials of the many agencies with which the U.S. attorney works, such as the FBI, the federal judges and court officials, local law enforcement and prosecutor’s offices, etc., about the quality of the work of the office.

I have not seen the EARS report on Paulose’s office. Eggen’s sources say that it includes still more complaints about Paulose, so serious that the head of the national office came in to talk to her about it.

Most of the U.S. attorneys who were forced out by Team Gonzalez to make way for “loyal Bushies” received very good EARS evaluations.

The Seattle Times got hold of a copy of the most recent review of former Washington State U.S. Attorney John  McKasy before he was forced to resign, and it concluded that “McKay is an effective, well-regarded and capable leader of the [U.S. attorney’s office] and the District’s law enforcement community.” His superiors in Washington requested his resignation seven months later.

Dan Eggen reported back in February that six of the seven U.S. attorneys whose resignations had been requested had received positive job evaluations. Technically, Paulose did not replace one of the fired U.S. attorneys. Her predecessor, Thomas Heffelfinger was on a list of U.S. attorneys to be fired, but resigned before his resignation could be requested and maintains that his departure was entirely voluntary. But Heffelfinger’s presence on that list certainly connects Paulose to the larger issue of the U.S. attorney hirings and firings that played such a big role in ending the tenure of Attorney General Alberto Gonzales.

How much more awkward does Paulose’s situation become if her negative EARS review is compared with those of the fired U.S. attorneys?

    Coordinate your thoughts with former SD US Atty MICHELLE TAPKEN’S FED GRAND JURY…and the obstruction of such by SD AG Larry Long who “threatened Michelle’s son” with a criminal investigation looking at The Dan Nelson Automotive loan business.
